First of all, let me say that in principle I support the controversial and much discussed Stand Your Ground law. Why I do doesn’t really matter; and, for all intents and purposes of this post, I don’t feel like discussing why I support it. However, what I’d like to talk about is yet another case where someone was shot and killed and the shooter has yet to be arrested. So why do I want to talk about this case? Well, as I see it, this case in particular is very interesting given the racial dynamic. For weeks now I’ve heard a lot of talk about the Stand Your Ground Law being racist. Or, described as a law that gives license to racist individuals to murder people of color indiscriminately.

Well, the victim in this particular case is a 22-year-old white male who as it turns out, was mentally retarded and had the mental capacity of a 12-year-old. The shooter however, happens to be a black man. What I find particularly interesting, is the fact that there is very little talk of justice for Daniel Adkins much in the same way there’s talk of justice for Trayvon Martin. And I find this particularly interesting given the politicization of the incident involving George Zimmerman’s claim of self-defense as it relates to the NRA pushed and ALEC supported Stand Your Ground Law. In case you’ve been under a rock for the past few weeks, the Stand Your Ground Law currently exists in 24 states. Arizona, where Daniel Adkins was killed, like Florida, also has their own version of Stand Your Ground.

LAVEEN – Police are saying more about a shooting at a Taco Bell Tuesday night in which one man died.

They’re also identifying the victim as 29-year-old Daniel Adkins.

About 7:30 p.m., a 22-year-old man and his girlfriend ordered food at the Taco Bell drive-thru and were told to pull up while their order was prepared.

At the same time, Adkins stepped around a corner into the path of the vehicle and angry words were exchanged between he and the driver.

They got into an altercation and Adkins was shot once by the driver. He died at the scene.

The driver, a 22-year-old black male, called police but has not been arrested.

At first, the couple claimed that Adkins had a metal pipe that he swung at them — but it turns out he was holding a dog leash with his yellow lab on the other end.

Family members want that driver arrested, but he’s claiming self-defense.

“He needs to be behind bars. I’ll never see my brother again,” says sister Marina Reyes. “If he felt that my brother was threatening him, he could have easily just rolled up the window and called the cops.”

A metal pipe or bat was never located. An independent witness did say Adkins swung his fists in the driver’s direction.

“He swung his fist towards the driver window, and at some point the driver shot him,” says Phoenix Police Sgt. Tommy Thompson. “Just because we don’t book a person immediately does not mean we don’t charge a person at a later date.”

The dog, Lady, stayed by Adkins’ side until the Humane Society came. Adkins lived with his mom and dad. He’s 29, but his family says he’s mentally disabled and has the mental capacity of a 12-year-old. He didn’t drive, and walked wherever he went.

“This person is still on the loose and I don’t agree with that. So he’s saying self defense, then where’s the weapon? Where’s the pipe? They didn’t find anything on my brother,” says Reyes. “He was just too aggressive, you don’t need to go that far.”

The shooter’s name has not been released. The investigation is still ongoing.

Oh wow, the shooter was black and he wasn’t arrested?

Now, you would think that my lefty friends in the media would be all over this case right now. Given all the hoopla surrounding the situation in Sanford, Florida, one would expect the media to be right on top of this case in Arizona in an attempt to add fuel to the fire. But it’s been almost a week since Adkins was killed, and not a word from my lefty friends on any of my favorite shows on MSNBC’s prime-time nightly lineup. Nope, not even a mention in passing or anything. Lemme guess: nobody is talking about Daniel Adkins because unlike Trayvon, he wasn’t armed with Skittles and ice tea? Heck, not even an investigation to see if he was wearing a hoodie at the time?

Oh, about me supporting the Stand-Your-Ground laws?

Before the new laws were enacted, the use of deadly force in self-defense without first trying to flee was usually only justifiable by those defending themselves in their own homes.

Recent legislation in numerous states, however, removed the requirement that a person defending him/herself in virtually any public place first try to retreat before using deadly force.

The first state to adopt the new self-defense laws was Florida in 2005. Since that time, at least 13 other states, including Tennessee, Texas, Georgia, Arizona, Idaho, and Kansas, have followed suit.  (source)

Look, I’m just going to go ahead and say it: my white liberal friends in the media could give a rats ass about Atkins being the latest victim of yet another states Stand Your Ground Law. And, they don’t because of the fact that he’s white, and he was killed by a black man. Yep, nothing racially polarizing about this one, folks – yep, nothing to see here. Hell, black men kill white people everyday; hell, why run that tired meme into the ground. I mean the last thing they would want to be is racist like the noise makers over at Rupert’s place, right? Yep, fair and balanced in no way rhymes with hypocrisy. But hey, that’s a great thing, I suppose; yep, justice and equality for all.

  1.  Good article.  I actually just found out about Daniel Adkins, oh about 5 minutes ago.  I found this strange, because I tend to stay pretty on top of current events.  This tragedy is so similar to the Trayvon Martin case that it makes no sense for it not to be covered and compared.  The only reason I can see for this, as you apparently also believe, is that the races are exactly reversed (a white-hispanic killing a black man vs. a black man killing a white-hispanic).

      •  The Martin situation was indeed bad.  However, I am not convinced that Zimmerman is guilty of any unlawful actions.  I leave that for the Justice System to decide.  With that said, I am also not convinced that Adkins’ shooter is guilty of any unlawful actions.  I wasn’t there; I don’t know the details.  The thing that drives me nuts is the double standard.  Why is Trayvon’s death worthy of forming a nation-wide lynch mob but Adkins’ gets swept under the rug?

  2. That is not a stand your ground case.

    This falls under the castle doctrine, if your in your car or home and attack you can use lethal force.

    Generally in normal non stand your ground states you wouldn’t, given the described situation, have the right to use deadly force unless he was trying to break the window of the car to further attack the people in the car.

  4. Good article. The shooter should definitely be arrested, and they should be asking if the food place had external cameras. I think the difference between this and the Martin case was that the parents and their lawyer went out seeking national attention. The Martin case was pretty quiet at first as well. I would encourage this family to tell their story. However, as with the Martin case you could be asking for more trouble as the public may screw up the facts.

  5. First of all, let me make it clear that I do not support the ‘Stand Your Ground Law’. And I do think that the shooter in Arizona should be arrested. Yet, I still think that Florida incident is very different from the one in Arizona.

    In Florida, the shooter had contacted the police BEFORE the attack (911 calls), was told by the law enforcement not to follow Trayvon, and he still chose to do it thereby ignoring the advise. It was the shooter who confronted the victim first, and based on the 911 calls, there is some evidence to support the theory that the shooter was profiling against a particular race.

    In the case in Arizona, the shooter does not seem to have started the fight, whatever happened was at the spur of a moment, and there is nothing to suggest that any racial profiling took place. I do agree that the shooter probably had a choice to use means other than the use of deadly force to avoid further escalation of the situation.

Ken, an excellent point!  Even though I agree the shooter should be arrested and investigated, this is totally different from the Martin case….no stalking involved and it took 27 days before any action was taken…as a matter of fact, if the media hadn’t brought it to attention, NOTHING would have come of it!  ALL shootings should be investigated and NOT summarily dismissed under some b.s stand your ground law…

  7. Why aren’t the hispanic from Arizona calling they leaders like LULCA or La Raza help them get an arrest and clarification. People have to sign Petitions and call the T.V. Sations and write Obama he is the President of all People not just Blacks.

  8. He should be arrested. It doesn’t matter what race. I don’t think any of this has to do with race. IMO, it has to do with a allowing people to carry guns. I probably could have been shot several times, bacause as a 5′ 2″ woman, I have come to the aid of others. I recently witnessed a man in a vehicle almost run over a woman and she threw a flyer at his car and told him to watch where he was going. He turned around in his vehicle and started yelling at the woman and saying she was threatening him he was going to call the police. I was watching and getting mad myself. He stopped his vehicle and started getting out of his car yelling female slurs at her. I got up in his face and told him to get back in his car and that he was in a vehicle and needed to be careful. My latino BF and a a black man were about to get involved. He retreated and drove off and said something nasty to me

    This was just about the timet as I heard about Trevon.

    I don’t really care anymore if I am shot, I believe we have rights and that people should help one another and NO ONE has the right to pull a trigger on someone even if you feel threatened, or are angry. Plus, where has all the civility gone in this world. Very sad.

    This 22 year old was most likely driving too fast. He probably almost killed him. Being a pedestrian is difficult in a car culture. When the Atkins was mad, he killed him. IMO, end of story. He needs to be taken in and a trial with a judge and jury needs to occur. Shame on the police. I guess from this story, the apple doesn’t fall from the tree. Poor baby that his GF is carrying. I feel sorry for the baby. Hopefully the woman will break free froma violent famlily.

    I am very sad for Atkins parents. No one should have to go through that.

  9. It was on CNN last weekend.  But considering this happened on early April and now being late April, yea, I would say that they thought this story is not important to them.  Or better, this story does not fit well with their political agenda.  Who know what these commie and atheists think?
